General terms and conditions

These Terms and Conditions (“Agreement”) govern the use of the Mediapapa plugin and services offered by BE API, a French SAS registered under SIRET number 51417809400033, with registered office at 9 RUE DES COLONNES, 75002 PARIS France, hereinafter referred to as “BE API”, “we”, or “us”.

By installing, activating, or using the Mediapapa plugin (hereinafter “the Plugin”) or any associated web-based services (hereinafter “the Services”), you agree to be bound by the terms of this Agreement.

1. Definitions

  • Plugin: Refers to the Mediapapa WordPress plugin distributed by BE API.
  • Services: Refers to the cloud-based services provided by BE API in connection with the Plugin, including but not limited to image compression, artificial intelligence assistance, and media optimization.
  • Subscription: A paid plan required to access premium features and Services offered by Mediapapa.
  • User, you, or Customer: Refers to the individual or entity installing, accessing, or using the Plugin and/or Services.

2. Scope of the Agreement

This Agreement applies to your use of the Plugin and any connected Services provided by BE API. These Terms do not apply to third-party plugins, services, or websites you may use in conjunction with Mediapapa.

3. License

BE API grants you a limited, non-exclusive, non-transferable, and revocable license to use the Plugin in accordance with your subscription level and subject to the terms herein.

You may not:

  • Reverse-engineer or decompile the Plugin or its related Services.
  • Resell, sublicense, or redistribute the Plugin without explicit written consent.
  • Use the Plugin in violation of applicable laws or regulations.

4. Subscription and Access to Services

Some features of Mediapapa require an active and valid Subscription. Without an active Subscription:

  • Access to Mediapapa web services (e.g., compression API, AI features) may be restricted or disabled.
  • You will not receive updates, support, or security patches for the Plugin.

Subscription terms, pricing, and renewal policies are available on our website and may be updated at any time with notice.

5. Web Services Dependency

The Plugin relies on cloud-based infrastructure operated by BE API. To function properly, your WordPress installation must be able to communicate with our API endpoints. We are not responsible for any limitations caused by server misconfiguration, firewall rules, or third-party blocking.

Downtime or degraded performance of these services may affect Plugin functionality.

6. Updates and Compatibility

We may update the Plugin and its Services periodically. It is your responsibility to ensure that your environment remains compatible with our Plugin. We strive to maintain backward compatibility but do not guarantee support for all older WordPress versions.

7. Support

Support is only provided to users with an active Subscription. Support is limited to:

  • Installation and configuration assistance.
  • Bug reporting and troubleshooting related to Plugin functionality.
  • Excluding custom development or third-party conflicts.

Support channels are available on our website.

8. Data Collection and Privacy

Use of the Plugin and Services may involve the transmission of data to our servers, such as:

  • Media files for optimization.
  • Metadata related to your site environment or Plugin usage.
  • Content you explicitly submit to AI features.

All data is handled in compliance with the EU GDPR and our Privacy Policy.

9. Termination

We reserve the right to suspend or terminate your access to the Plugin and Services at any time in case of:

  • Breach of these Terms.
  • Abuse of Services or attempt to circumvent licensing mechanisms.
  • Non-payment or chargebacks on Subscription.

Upon termination, your right to use the Plugin and Services will cease immediately.

10. Refund Policy

This Agreement shall be governed by the laws of France. Any disputes shall be submitted to the exclusive jurisdiction of the courts of Paris, France.

13. Changes to the Terms

We reserve the right to update these Terms at any time. Users will be notified via our website or by email if significant changes are made.
